TERMS AND CONDITIONS FOR COPENHELLSHOP.DK
Live Nation offers online shopping for consumers via the Copenhellshop.dk online store (hereinafter 'Online Store'). The terms and conditions set out below ('Terms and Conditions') constitute an agreement between you and Live Nation that applies to purchases you make in the Online Store. You should read and understand these Terms and Conditions carefully before making a purchase from the Online Store.
WHO ARE WE?
References in these Terms and conditions to "Live Nation", "Live Nation Denmark ApS", “Copenhellshop.dk” "we" or "us" shall be references to Live Nation Denmark ApS., a public limited company registered in Denmark with VAT code Dk-15897309, on Frederiksberg Allé 3, 1621 København V, Denmark and with Central Business Registration no: 15897309.
If you have any questions or need help with the Online Store, its content or some of the Terms and Conditions, please contact us at email@example.com. Please avoid mentioning sensitive payment information in e-mail correspondence as this type of communication is not secure by definition.
CHANGES TO TERMS AND CONDITIONS
Changes may be made to these Terms and Conditions. Please check regularly to ensure you are familiar with any changes. The issue date of this version of the Terms and Conditions is indicated at the top of this page. If you make a purchase in the Online Store, you agree to abide by the version of the Terms and Conditions available in the Online Store on the respective purchase date. Previous versions of the Terms and Conditions are available from firstname.lastname@example.org.
PURCHASE OF ITEMS
Payments can be made in the Online Store via a secure connection between Copenhellshop.dk and Bambora. Payments are processed by Bambora in accordance with an agreement with Live Nation.
You can pay with MobilePay, Dankort/VISA-Dankort, eDankort, VISA, VISA Electron, MasterCard, Maestro, American Express and JCB in the Online Store. Payments will not be taken from your account until items are shipped.
All prices stated in the Online Store include DK VAT of 25%.
You agree that Live Nation may deduct amounts from the payment card or account specified by you (whichever is relevant) for the purchase of items. Making purchases in the Online Store requires that you are entitled to enter contracts and/or make purchases electronically.
Live Nation shall be entitled at any time to change prices and availability of any item or collection of items without advance notice. We will not offer refunds in the event of temporary or permanent price drops following a purchase at a higher price.
Unless stated otherwise below, all purchases are binding.
Items purchased in the Online Store will be delivered via Postnord, GLS, Bring, UPS and DHL.

RIGHT TO CANCEL IN CONNECTION WITH ITEMS
You can cancel contracts in accordance with Section 18 of the Danish Consumer Contracts Act. The time limit for cancelling a contract is 14 days from the date of delivery. You will have received information about your right to cancel and information about Copenhellshop.dk prior to placing your order.
If you have not received this information, the time limit will not start until you have received the information in writing (in hard copy or by e-mail for example). The time limit will expire, however, 12 months after the date on which you receive your items. If you have received information prior to placing your order and you receive your purchases on Monday 1st, for example, you have until Monday 15th inclusive in which to cancel the contract. If you do not receive information until after you have placed your order, for example on Wednesday 3rd, you have until Wednesday 17th inclusive in which to cancel the contract.
If the time limit expires on a public holiday, Sunday, Danish Constitution Day, Christmas Eve or New Year's Day, you can wait until the next working day.
If you wish to exercise your right to cancel, you must inform Copenhellshop.dk that you wish to cancel your purchase in writing no later than 14 days after receiving your items. You must then return these items to the address below no later than 14 days after the date on which you notified Copenhellshop.dk of your cancellation.

If you wish to exercise your right to cancel, you can use the standard cancellation form here of these Terms and Conditions.
It will suffice if you have entrusted items to a postal service or another company, which has undertaken to ship your items, prior to the expiry of the time limit. If you want proof that you have cancelled in time, keep the receipt showing that you entrusted items to a postal service etc. for shipping. You will be responsible for the costs associated with returning items.
You may not cancel a contract by not wanting to receive items or you fail to collect items from a post office etc.
The right to cancel shall be void if the seal is broken on vinyl records, DVDs, CDs or other sealed items containing audio or video recordings.
Returned items must be in their original packaging.
You accept the risk of any reduction in the value of items, resulting, for example, from damage or use during the period in which the items were in your possession. Consequently, you shall reimburse Copenhellshop.dk for any reduction in value if items are to be returned.
Return items along with the relevant invoice (or a copy of the front and back page).
COMPLAINTS ABOUT ITEMS
Items are covered by the defect regulations in the Danish Sale of Goods Act.
Please check items you receive for any errors or defects. If you receive a defective or incorrect item, please contact Copenhellshop.dk at email@example.com as soon as possible after noticing that your item is defective or incorrect. You must raise a complaint within a 'reasonable period' after discovering that your item is defective.
Once we receive notification of errors or defects, we will send you a franked returns label. Return items in the same condition as you received them and enclose a description of the damage or error. We will then send you a defect-free or correct item as the case may be. Incorrectly delivered items must be returned in an unused and undamaged condition in their original packaging (seals and protective plastic covers must not be broken when purchasing vinyl records, DVDs, CDs and other sealed items including audio and video recordings.
Return items along with the relevant invoice or a copy (front and back page). Enter the reason for your return on the back of the invoice.
If you wish to make a complaint about your purchase, contact firstname.lastname@example.org.
If a resolution cannot be found between you and Live Nation, you can file a complaint with:

If you are a consumer resident in another EU country, you can also register your complaint on the European Commission Online Dispute Resolution platform. We may assign our rights and obligations in accordance with the Terms and Conditions without your consent provided such assignment does not adversely affect your rights in accordance with the Terms and Conditions.
If required in accordance with the Terms and Conditions, Live Nation will send you information by e-mail at your registered e-mail address and you should send information to Live Nation at firstname.lastname@example.org.
Live Nation shall not be responsible for failure to comply with obligations arising from circumstances beyond its control.
These Terms and Conditions therefore constitute the entire contract between you and Live Nation in relation to the respective subject matter and replace any previous written or verbal contract or agreement between you and Live Nation.
You shall be responsible for ensuring the accuracy of information provided. Live Nation reserves the right not to process orders in the event of fraudulent practice or suspected fraudulent practice or incomplete information.
PROCESSING OF PERSONAL DATA
LAW AND JURISDICTION
Any dispute regarding the interpretation or application of these Terms and Conditions shall be subject to Danish law and the Danish courts shall have jurisdiction.
THESE TERMS AND CONDITIONS (”GUIDELINES”) CONSTITUTE YOUR AGREEMENT FOR YOUR LIVE NATION GIFT CARD. UNLESS OTHERWISE SPECIFIED, ELECTRONIC GIFT CARDS WILL ALSO BE SUBJECT TO THESE GUIDELINES. THE GIFT CARD IS ONLY VALID IN COPENHELLSHOP.DK AND NOT AT THE COPENHELL FESTIVAL.

1.1 By purchasing, using or attempting to use a gift card, you accept and agree to be bound by these Guidelines.
1.2 If you let another person use your gift card, you must tell that person that s/he will be bound by these Terms and Conditions.
2 ABOUT YOUR GIFT CARD
2.1 Your gift card is issued by COPENHELL v. Live Nation Danmark ApS – a company registered in Denmark with the following address: Frederiksberg Allé 3, 1621 København V, Danmark and the following corporate registration / VAT number: 15897309.
2.2 Your gift card contains the monetary value which was paid at the point of purchase. It is not a credit card, debit card or cash card, and the balance on your card will not earn any interest. The gift card is only valid in copenhellshop.dk and NOT at the COPENHELL festival.
2.3 Your card is valid for 24 months from the purchase date.
2.4 The gift card cannot be returned or refunded, except from situations that give you the right to return it, e.g. if it is defective or according to the right of withdrawal as described in § 6. You cannot cancel your purchase. Any refunds will only be made to the person who originally purchased the gift card.
2.5 You cannot exchange your gift card to any other currency or type of gift card, and any unused amounts from two or more gift cards cannot be consolidated on a new gift card for COPENHELL Shop.
2.6 Once the monetary value loaded onto your card at the time of purchase has been used, the card cannot be reloaded.
3 GIFT CARD PURCHASE AND ACTIVATION
3.1 You can purchase a gift card from COPENHELL at www.copenhellshop.dk
3.2 You can pay for the gift card with your credit card or MobilePay.
3.3 You will receive an order confirmation email when you have purchased and paid for a gift card.
3.4 When purchasing the gift card online you should follow the normal order procedure set out on the website. This process includes a final confirmation screen which allows you to check and confirm your order and conclude the contract.
4 WHAT CAN YOU BUY WITH YOUR GIFT CARD?
4.1 The card can only be used to pay for products sold in www.copenhellshop.dk
4.2 You CANNOT use your card to buy products or services other than those available at www.copenhellshop.dk
4.3 No change will be given on purchases made with your gift card. Any unspent portion of the value loaded onto the card at the time of purchase will remain available for future use, in accordance with these guidelines.
5 WHERE CAN YOU USE YOUR GIFT CARD?
5.1 Your gift card can be redeemed in part or in full at www.copenhellshop.dk
5.2 You CANNOT redeem your card on any other websites than www.copenhellshop.dk, not even ticketmaster.dk or livenation.dk.
5.2.1 You CANNOT redeem your card in merchandise shops or restaurants/food stalls, bars and elsewhere at the COPENHELL festival.
5.3 In case the price of the product you are buying exceeds the monetary value loaded onto your gift card at the time of purchase, your payment can be combined with different payment method, such as a credit or debit card. In respect of online purchases at www.copenhellshop.dk, the full value of any unused funds remaining on the card must be exhausted before another payment method will be accepted in respect of the remaining value of the transaction.
5.4 When you authorise a transaction:
(a) you are confirm that you agree to pay the purchase price of the www.copenhellshop.dk products obtained; and
(b) you are agreeing to pay the purchase price by way of a reduction in the value that was loaded on your gift card at the time of its purchase.
5.6 You acknowledge that your gift card may not be used to purchase goods or services that COPENHELL v. Live Nation Danmark is not permitted to supply to you.
6 CONSUMER RIGHTS - RIGHT OF WITHDRAWAL
6.1 If you have purchased your gift card online or by telephone and are contracting as a consumer the following consumer rights apply.
6.2 Pursuant to Section 17 of the Danish Act on Certain Consumer Contracts, you have the right to withdraw from your contract to purchase the gift card.
6.3 The right of withdrawal period is 14 days. As a main rule, the right of withdrawal period is calculated from the day you receive the gift card.

7 GIFT CARD EXPIRY
7.1 You are entitled to use your gift card to purchase COPENHELL products for a period of 24 months from the date of purchase.
7.2 Once 24 months have passed since the date of purchase, you will not be able to use your gift card again, even if all or part of the value loaded at the time of purchase remains on the card. Instead you can redeem the residual value of the card in accordance with clause 2.5.
9 RIGHT TO TERMINATE, CANCEL OR REFUSE A TRANSACTION
9.1 COPENHELL v. Live Nation Danmark may terminate this agreement, cancel your gift card or refuse a transaction if we suspect that the card is being used fraudulently, or in an unauthorised or illegal manner, or if we have reason to believe that you are in breach of these guidelines.
9.2 If COPENHELL v. Live Nation Danmark needs to investigate a transaction on the card, we ask that you cooperate with us, the police and any other authorised body requiring your co-operation.
9.3 COPENHELL v. Live Nation Danmark can cancel any card and/or terminate this agreement and refund any unused funds to you at any time if we give you 2 months’ notice. The card remains Live Nation Danmark’s property.
10 YOUR PERSONAL DATA
11 LIMITATION OF LIABILITY
11.1 You are responsible for the use and security of your gift card, and you are liable for all transactions for which your card is used (except to the extent of any fraud or negligence by COPENHELL v. Live Nation Danmark or any employee of COPENHELL / Live Nation Danmark).
11.3 Live Nation Danmark shall not be liable for loss of business, use, profit, anticipated profit, contracts, revenues, goodwill or anticipated savings; loss caused by Live Nation Danmark’s gift card not working as expected, loss due to cancellation of agreements with third parties or negligence or loss caused by disappearance or corruption of data or information, even if Live Nation Danmark has been advised of the possibility of such loss or damage.
11.4 The following conditions involve exemption from liability according to the guidelines when they occur after entering into the agreement and prevents the contract (force majeure): labour disputes, strikes, lockouts and any other conditions not controlled by any of the parties, such as fire, war, mobilization or unforeseen military drafting of a similar extent, sabotage actions, requisition, impoundment, currency restrictions, riots and disturbances, negligence or actions from a third party.
11.5 Subject to the terms and conditions of this agreement and to the extent permitted by law, COPENHELL v. Live Nation Danmark shall have no liability to you beyond the amount of unused funds which remain on the gift card on the date on which:
(a) the card is cancelled by Live Nation Danmark or
(b) this agreement is terminated by Live Nation Danmark or
(c) the card expires.
11.6 Nothing in this agreement seeks to exclude or limit any liability for:
(a) death or personal injury caused by negligence;
(b) fraudulent misrepresentation; or
(c) any other type of liability which cannot by law be excluded or limited.
COPENHELL v. Live Nation Danmark may change the guidelines of this agreement at any time by posting an amended version on livenation.dk for one or more of the following reasons:
(a) to reflect the introduction or development of new systems, methods of operation, services or facilities (including, without limitation, the addition or removal of goods or services that may be purchased with the gift card);
(b) to reflect a change or an expected change in market conditions, general good practice or the cost of providing services to our customers;
(c) to comply with any contract, law, regulation or order binding on Live Nation Danmark;
(d) to conform with or anticipate any changes in the law or taxation, any codes of practice or recommendations of the Danish Financial Services Authority (Finanstilsynet) or other regulatory body;
(e) to ensure that our business is run prudently and remains competitive;
(f) to take account of a ruling by a court, ombudsman, regulator or similar body having legal or commercial jurisdiction over Live Nation Danmark;
(g) to make the terms and conditions of this agreement fairer or clearer for you;
(h) f to rectify any mistake that might be discovered in due course.
13.1 Any delay or failure to exercise any right or remedy under this agreement by Live Nation Danmark shall not be construed as a waiver of that right or remedy or preclude its exercise at any subsequent time.
14.2 If any provision of this agreement is deemed unenforceable or illegal, the remaining provisions will continue in full force and effect.
14.3 We reserve the right to assign our rights and benefits at any time without prior written notice to you. We reserve the right to subcontract any of our obligations under this agreement.
14.4 No third party who is not a party to this agreement has a right to enforce any of the provisions of this agreement.
14.5 This agreement and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims) shall be governed by and construed in accordance with Danish law. You irrevocably agree to submit to the non-exclusive jurisdiction of the courts of Denmark in relation to any claim or matter arising out of or in connection with this agreement (including non-contractual disputes or claims).
